If the inspector came by tomorrow morning, could you prove you had done your job?
In Canada, it is no longer safety that the courts judge. It is the proof of your due diligence.
Since 2004, section 217.1 of the Criminal Code of Canada (the Westray Law, Bill C-45, known in Quebec as Bill C-21) has required anyone who directs the work of other people to take reasonable steps to prevent bodily harm arising from that work.
In plain terms, if something happens in your establishments, you will have to show that you acted reasonably by proving that you fulfilled your duties of Foresight, Efficiency and Authority.
Not that you thought about it. Not that you intended to do it. That you did it, on a specific date, and that you have the documents to prove it.
3 cases that should keep you up at night.
Metron Construction case (2013)
4 workers died in a scaffold collapse. The company was fined $750,000. Project manager Vadim Kazenelson was sentenced to three and a half years in prison. The first individual prison sentence under the Westray Law.
L'Isle-Verte tragedy (2014)
32 elderly residents died in the fire at the Le Havre residence. There were no sprinklers in the area where the fire started. The owners faced a $3.8 million civil lawsuit. The coroner recommended major regulatory changes.
The cost of a poorly kept paper binder
In Quebec, fines for non-compliance with the Act respecting occupational health and safety (LSST) range from $1,000 to $100,000 per offence. They can be multiplied for each day you remain non-compliant. A paper binder in a filing cabinet is no longer credible evidence. An undated page, a forgotten update, a missing signature: these are the details that turn an “I tried” into a “you proved nothing”.
Previo was designed to answer a single question: can you prove your due diligence?
Every action you take in Previo is time-stamped and archived. Not in a binder gathering dust. In a digital log available 24 hours a day, from your office, your phone or directly in the field.
When the inspector arrives, you open your dashboard for them. Everything is there! Compliant with the National Fire Code of Canada and the Quebec Safety Code.
When a defence lawyer or a coroner asks “what did you do to prevent this incident”, you generate a report in three clicks. Printable format, digital format, court-ready format.
450+ automated compliance checkpoints
L'Inspecteur Previo analyzes each piece of equipment against the Quebec Safety Code and the NFC 2020. You receive a gap report with concrete corrective actions.
Time-stamped log
Every inspection, every training session, every evacuation drill is recorded with the date, a signature and, for some, photo evidence. Available to the authority having jurisdiction during an inspection.
Automatic regulatory updates
When the RBQ or the ministry updates a standard, your Previo is updated. You never miss a regulatory change again.
